<strong>گملے میں لگایا ہوا پودا کتنا بڑھ سکتا ہے؟<br />

اگرپودےکو بڑھانا مقصود ہو،تو اسے گملے سے نکال کر زمین کے کشادہ سینے میں منتقل کرناہوتا ہے، ورنہ گملے میں لگاہوا پودا ایک حد تک بڑھنے کے بعد نشوونما کی صلاحیت سے محروم ہو جاتا ہے۔ اور اسکے برگ و بار گلنے سڑنے لگتے ہیں۔</p>
<p style="text-align: right;">پاکستان کا پودا گملے میں لگا نے کے بعد ہم بھول گۓ کہ اسکو ہم نے کشادہ زمین کے سینے میں منتقل کرنا ہے۔ اب اس پودے کینمی اور سانس رکنےلگی ہے۔ سورج کی روشنی بھی اب اسکے لۓ بیکار ہوتے جارہےہیں۔</p>
<p style="text-align: right;">پاکستان جو آدھی صدی سےگزرکر آدھی صدی کی کہانی بیان کرنے والا ہے، اس کے پاس کہنے کوکیا ہے؟ مرکز کے اختیارات اور صوبائ خود اختیاری سوال، پارلیمانی یا صدارتی نظام کی بحث، ریاست اور مذہب کے تعلق کی نوعیت، بار بار آیئین کی پامالی، اقساط میں خودکشی کرتی ہوئ جمہوریت، لمبی طویل فوجی بوٹوں کی چاپ، پاکستان کے ٹوٹ کر آدھا ہو جا نے کا نوحہ، نمائندہ رہنماؤں کی جلاوطنی، قائد عوام کا قتل، سڑکوں پر بہتا شہید جمہوریت کا خون، ایجنسیوں، بیوروکریسی اور اپوزیشن کی سازشیں، سیاسی اور مذہبی جماعتوں کے تضادات، عوام کا بے سمت ہجوم ۔ مگ افسوس ہم نے آج بھی کچھ نہیں سیکھا۔</p>
<p style="text-align: right;">ہمارا المیہ یہ ہے کہ ہمارے غیر نمائندہ ریاستی اداروں نے آ ج تک بین الاقوامی اصولوںاور بنیادی اقدارکی نفی کی ہے اور انسانی ذندگی کی عضمت کوپامال کیا ہے۔ اجتمای مفاد کی بجاۓ انفرادی مفاد کو سامنے رکھا ہے۔ جس سے ہمارے نظام کامجموی ڈھانچہ ریت کے ٹیلوں کی طرح بکھرتے بکھرتے صحرا بن چکا ہے، جہاں ہر طرف سراب نظر آتے ہیں۔</p>
<p style="text-align: right;">پاکستان کی تاریخ بحرانوں اور جرنیلوں کی تاریخ رہی ہے، جس میں ججوں اور جرنلسٹوں کا بطور آلہ کار ایک کلیدی کردار رہا ہے۔ ہر موڑ پر ایک نیا چیف مارشل لا ایڈمنسٹریٹر نۓ سائن بورڈ کے ساتھ کھڑا دکھائ دیتا ہے۔ جس میں کسی پر اسلامی جمہوریت، کسی پر بنیادی جمہوریت اور کسی پر حقیقی جمہوریت لکھاہواتھا۔</p>
<p style="text-align: right;">جمہوریت کے راستے سے ہٹانے والے ان سائن بورڈز کی منزل تباہی و بربادی کی گہری کھائ تھی ۔ ان غیر نمائندہ حکمرانوں نے جمہوریت کی نشو ونما روکنے کے لۓ سیاسی قیادت کو ہمیشہ گملوں میں رکھنے کی سازش کی ہے۔ اگر کسی سیاستدان نے اپنی جڑیں کشادہ زمیں میں منتقل کرنے کی کوشش کی ہے تو اسے نشان عبرت بنا دیا گیا ہے۔ قید وبند کی صعوبتیں، زہنی جسمانی اذیتیں اور شہادت اس کی قسمت میں لکھ دی گئ ہیں ہم آج بھی جمہویت کی تلاش میں ہیں۔ اور آج بھی خطرہ ہے کہ ہمیں منزل سے بھٹکا کراندھیرے راستے پر ڈالنے کی سازش ہورہی ہے۔ این ار او اور میمو اس سلسے کی کڑیاں ہیں۔</p>
<p style="text-align: right;">وزیرِاعظم یوسف رضا گیلانی نے قومی اسمبلی میں اپنے خطاب میں کہا کہ انیس سو ننانوے میں نواز شریف کی منتخب حکومت کا تختہ الٹنے کا ذکر کرتے ہوئے کہا کہ اس وقت بینظیر بھٹو نے ان سے کہا تھا کہ ’یہ سیج ہمارے لیے نہیں سجایا گیا اور یہاں نہ ہم آئیں گے اور نہ وہ (نواز شریف)‘۔</p>
<p style="text-align: right;">وزیرِ اعظم نے حزبِ اختلاف کو خبردار کرتے ہوئے کہا کہ ’ اگر اب بھی کوئی سیج سجایا گیا تو وہ نہ آپ کے لیے ہوگا نہ ہمارے لیے‘۔</p>
<p style="text-align: right;">جو معاشرے تبدیل ہونے کی صلاحیت اور قوت کھو دیتے ہیں وہ گناہگار ہوجاتے ہیں اور انسانی معاشرے کا سب سے بڑا گناہ &#8216;جمود&#8217; ہے۔ فرخ خان پتافی اپنے &#8216;روزنامہ ایکسپریس&#8217; میں شائع ہونے والے آرٹیکل &#8216;ہم نے کیا سیکھا؟&#8217; میں یہ سوال کرنے کے ساتھ ساتھ یہ تجزیہ بھی دے رہے ہیں کہ ہماری فوج، عدالت، میڈیا اور سیاسی جماعتیں ماضی سے سیکھنے میں ناکام رہی ہیں۔</p>

<p style="text-align: right;">غیر جمہوری ریاستوں میں جو لوگ آ فاقی انسا نی حقوق، جمہوری آزادیوں، عوام کو اختیارات اور انصاف منتقل کرنےکی تحریکیں چلاتے ہیں اور نۓ جدیر نظام کی بشارت دیتے ہیں، ان کے نام ریاست غداری کا سرٹیفکیٹ جاری کردیتی ہے اور پھر اس باغی کو زہر کا پیالہ پینا ہوتا ہے، یا پھر تختہ دار پر پھانسی کے پھندے کو چومنا ہوتا ہے۔</p>
<p style="text-align: right;">سقراط سے زوالفقار بھٹو تک اور بے نظیر پھٹو کو سیکیورٹی رسک قرار دینے تک عدالت ریاست کی سب سے بڑی معاون رہی ہے۔ اور آج بھی ریاستی ادارے عدالت سے ہی فیصلہ صادر کروانا چاہتے ہیں کہ کون اہل کون نااہل اور کون غدار ہے۔ گزشتہ روز جسٹس آصف سعید کھوسہ کی سربراہی میں سپریم کورٹ کے پانچ رکنی بینچ نے متفقہ فیصلہ سُناتے ہوئے کہا کہ وزیر اعظم نے عدالتی احکامات پر عمل درآمد اور آئین کی پاسداری نہ کرکے اپنے حلف سے روگردانی کی ہے اور بادی النظر میں وہ ایماندار نہیں رہے اور اگر کوئی بھی شخص ایماندار اور امین نہ ہو تو وہ پارلیمنٹ کا رکن نہیں بن سکتا۔</p>
<p style="text-align: right;">عدالت کا کہنا تھا کہ وزیر اعظم نے آئین کی پاسداری پر اپنی سیاسی وابستگی کو ترجیح دی۔</p>
<p style="text-align: right;">عدالت کا یہ بھی کہنا تھا کہ صدر پاکستان اور وزیر قانون بھی بظاہر اپنے حلف سے روگردانی کے مرتکب ہوئے ہیں اور اُنہیں بھی ایسے ہی نتائج کا سامنا کرنا پڑ سکتا ہے۔</p>
<p style="text-align: right;">عدالت نے اپنے فیصلے میں کہا ہے کہ آئین کے ارٹیکل 189 کے تحت تمام ادارے سپریم کورٹ کے احکامات پر عمل درآمد کرنے کے پابند ہیں۔</p>
<p style="text-align: right;">پاکستان کا شمار ایسی ریاستوں میں ہوتا ہے جہاں اقتداراوراختیارات کا منبع فوج ہے۔ اور جو گزشتہ 64 سالوں سے دیگر ریاستی اداروں بیوکریسی، عدالت اور میڈیا کی معاونت سے نظام سلطنت چلارہی ہے۔</p>
<p style="text-align: right;">جب بھی میڈیا کی سول حکومت کی کرپشن مہم کے بعد فوج نے منتخب حکوت کوفارغ کیا تو قانونی جواز کا سرٹیفکیٹ عدالت نے ہی جاری کیا ہے۔</p>
<p style="text-align: right;">اس تناظر میں عدالت کے دو فرائص بن گۓ ہیں؛ شہری نما ئندوں کو ایمانداری یا غداری کا سر ٹیفکیٹ اور فوجی حکومتوں کو شب خون مارنے کے پعد قانونی جواز فراہم کرنا۔</p>
<p style="text-align: right;">کون اہل ہے یا نااہل اور کون ایماندار فیصلہ عوام نے کرنا ہے،<a href="http://www.brecorder.com/top-news/1-front-top-news/41846-people-of-pakistan-will-decide-the-eligibility-of-pm-babar-awan-.html"> کہ رہے ہیں پاکستان پیپلز پارٹی کے نائب صدر ڈاکٹر بابر اعوان</a> ، یہی جمہوری آفاقی اصول بھی ہے اورجدید ریاستوں کا دستور بھی۔</p>
<p style="text-align: right;">عاصمہ جہانگیر جو اپنے والد ملک جیلانی سے لے کر حسین حقانی تک انصاف کے لۓ عدالت کے دروازے پر کھڑی رہی ہیں؛ انہیں انصاف تو نہ مل سکا مگر آذاد عدلیہ کا بھرم ضرور کھل گیا۔ وہ واضع طور پر کہ رہی ہیں ’<a href="http://www.bbc.co.uk/urdu/pakistan/2009/12/091219_hrcp_asma_as.shtml" target="_blank">عدلیہ اپنے دائرہ کار سے تجاوز کرگئی ہے</a> اوریہ بہت ہی خطرناک بات ہوگی کہ سپریم کورٹ اراکین پارلیمان کی اخلاقیات پر فیصلے دے۔‘</p>
<p style="text-align: right;">میاں نواز شریف کی حکومت جب جنرل پرویز مشرف نے غیر آئینی طور پر پرطرف کی اور انہیں جلاوطن ہونا پڑا تو انہوں نے لندن میں سہیل وڑائچ سے کتاب لکھوائ <strong>غدار کون؟</strong> تو ا`س میں اپنی بیگناہی ثابت کرنے کے ساتھ ساتھ انہوں نے کارگل سے لے کر تمام اقدامات کا قصوروار عسکری اور انٹیلیجینس اداروں کو ٹھرایا، انہوں نے یہ تک لکہا کہ بی بی شہید اور آصف علی زرداری کے خلاف مقدمات انٹیلی جینیس ایجنسیوں کے کہنے پر بناے مگر سیاسی آزادی ملنے پر وہ یہ سب بھول چکے ہیں؛ وہ بھول چکے ہیں جب انہں فوجی آمر کے دور میں ھتکڑیاں لگائ گئیں، پنجرے میں لاد کر شہروں کا چکر لگایا جاتا تھا۔ آج جب ہمیں مزید سیاسی جمہوری آزادیوں کی طرف بڑھنا تھا، پی ایم ایل (ن) کے قائد کاغذ کا ایک ٹکڑا لے کر عدالت میں پہنچے ہیں، ا`ن کی انگلیاں شہری نمائندوں کی طرف ہیں اور وہ چلا چلا کر کہ رہی ہیں یہی ہیں غدار۔</p>
<p style="text-align: right;">پاکستان میں فوجی بالادستی کے تابع جو ریاستی نظام رہا ہے، ا`س کی ایک اہم خاصیت اختیارات، اقتدار اور وسائل کی مرکزیت رہی ہے۔ اس میں جس کسی نے بھی انسانی جمہوری وفاقی اصولوں کی بنیاد پر آفاقی حقوق اورصوبائ وسائل پر اختیارمانگا ہے ا`س کا نام غداروں فہرست میں ڈال دیا گیا ہے، پہلے ا`سکا میڈیا ٹرائل ہوا ہے اور پھر کورٹ میں۔ زیر نظر مضمون جو حسن مجتبیٰ نے لکھا اور بی بی سی اردو میں شائع ہوا ہے، میں قوم پرست غداروں کی ایک لمبی فہرست ہے۔</p>
<p style="text-align: right;">آج سازش ہورہی ہے کہ اس فہرست میںوفاق کے سربراہ عوام کے منتخب صدرآصف علی زرداری&#8217; حکومتی سربراہ وزیراعظم یوسف رضا گیلانی اور امریکہ میں سابق پاکستانی سفیرحسین حقانی کا نام شامل کیا جاۓ ؛ ان کا جرم عوامی سیاسی اداروں کی بالادستی کا مطالبہ اور جمہوری عوامی حقوق کو فوقیت دینا ہے&#8217; اس جرم کی بنا پر ان کی نہ صرف سیاسی بقا خطرے میں ہے بلکہ ذندگی بھی۔</p>

<p style="text-align: right;"><img class="alignleft size-full wp-image-68839" title="120109150506_hussain_haqqani_2" src="http://cdn.criticalppp.com/wp-content/uploads/2012/01/120109150506_hussain_haqqani_2.jpg" alt="" width="304" height="171" />’اوہ جیہڑا جالب سی نہ! اوہ غدار سی غدار! قید ہوئیا چنگا ہوئیا‘ یہ وہ الفاظ تھے پاکستان کے عوامی شاعر حبیب جالب کے محلے والوں کے جو یہ اس وقت کہتے جب جالب گرفتار ہو کر جیل چلے جاتے۔ وہ حبیب جالب، آج جن کے شعر اگر پنجاب کے وزیر اعلیٰ شہباز شریف اور پاکستان کے صدر آصف علی زداری سمیت پاکستانی حکمران اپنے جلسوں میں نہ پڑھیں تو ان کی سیاسی روٹی ہضم نہیں ہوتی۔</p>
<p style="text-align: right;">پاکستان میں غداری کے القاب و سرٹیفیکیٹس بانٹے جانے کی تاریخ شاید پاکستان کی اپنی تاریخ سے بھی کہیں زیادہ پرانی ہے اور غداری کے ٹھپے بنانے کی فیکٹری کا سفر آج بھی جاری و ساری ہے۔</p>
<p style="text-align: right;">مضحکہ خیز بات یہ ہے کہ پاکستان میں ایسا بھی وقت آیا کہ جب تاج برطانیہ سے غداری کے الزامات تلے آنے والے اسی مٹی کی خمیر سے اٹھے ہوئے رہنما اور کارکن برصغیر میں انگریزوں سے نام نہاد آزادی حاصل کرنے کے بعد بھی پاکستان میں حکومتوں کی جانب سے بھی غدار ٹھہرائے گئے۔</p>
<p style="text-align: right;">اس کی ایک بڑی مثال خدائي خدمت گار اور ’سرحدی‘ گاندھی خان عبدالغفار خان باچا خان ہیں جنہیں آخر عمر تک اپنے اہل خانہ اور ساتھیوں سمیت غدار کہا جاتا رہا۔ پھر وہ غفار خان کے ساتھ ان کے بھائی ڈاکٹر خان صاحب تھے کہ بیٹے خان عبدالولی خان کہ ان کے پوتے اسفند یار ولی، اجمل خٹک کے زمانوں سے پہلے حاجی ترنگ زئي جیسے درویش (جن کے مزار پر کچھ عرصہ قبل طالبان نے قبضہ کیا تھا) یہ سب کے سب ایک یا دوسرے دور میں غدار ٹھہرائے جاتے رہے تھے۔</p>
<p style="text-align: right;">سابقہ مشرقی پاکستان میں حسین شہید سہروردی، مولانا عبد الحمید بھاشانی اور بنگلہ دیش کے بانی شیخ مجیب الرحمان کو غدار کہا گیا۔ اگرتلہ سازش کیس کے تحت ان پر غداری کا مقدمہ چلایا گیا اور دوسری بار انیس سو اکہتر میں ان پر خفیہ طور پر مقدمہ چلا کر انہیں سزائے موت دے دی گئی۔ ذوالفقار علی بھٹو نے برسرِ اقتدار آتے ہی شیخ مجیب الرحمان کی سزائے موت منسوخ کر دی تھی اور پھر اسی ’غدار‘ ٹھہرائے جانے والے شیخ مجیب الرحمان کے بنگلہ دیش کو نہ صرف تسلیم کیا گیا بلکہ اسلامی سربراہ کانفرنس میں شرکت کرنے کے لیے ان کی آمد کے موقع پر انہیں اکیس توپوں کی سلامی بھی دی گئی تھی۔</p>
<p style="text-align: right;"><img class="alignleft size-full wp-image-68838" title="111230155656_asma-jehangir" src="http://cdn.criticalppp.com/wp-content/uploads/2012/01/111230155656_asma-jehangir.jpg" alt="" width="304" height="171" />یہ بھی انسانی تاریخ میں شاذ و نادر ہی ہوا ہو کہ پوری کی پوری قوم اور فوج کا ایک بڑا حصہ بھی غدار کہلایا جائے۔انیس سو اکہتر میں پاکستان کی تاریخ میں اس روایت کی بھی داغ بیل ڈال دی گئی جب پورے کی پوری بنگالی قوم کو غدار کہا گیا اور پاکستانی فوج میں بنگالی فوجیوں کو بھی غدار۔<br />
شاید لاہور کے پرانے لوگوں کو یاد ہو کہ اسی عاصمہ جہانگیر کے والد ملک جیلانی شیخ مجیب الرحمان کے پنجاب میں چند حامیوں اور دوستوں میں سے ایک تھے۔ وہ اکیلے ہی ان کی آزادی کے لیے بینر لیے مال روڈ پر کھڑے ہوا کرتے تھے۔<br />
یہی عاصمہ جہانگير جو جوانی میں داخل ہوتے ہی اپنے ابا کو حبسِ بیجا میں رکھنے کے خلاف مقدمہ لڑتی رہی تھیں جسے پاکستان میں مشہور عاصمہ جیلانی کیس کہا جاتا ہے۔ اسی کیس میں ججوں نے جنرل یحییٰ کو فقط اس وقت غاصب کہا تھا جب وہ اقتدار میں نہیں رہے تھے۔<br />
عبد الصمد خان اچکزئی پیر آف مانکی شریف، میاں افتخار الدین، فیض احمد فیض، مظہر علی خان، شيخ ایاز جیسے لوگ بھی مختلف دور میں حکومتوں اور ان کی کاسہ لیس میڈیا عرف قومی میڈیا کی طرف سےغدار قرار دیے جاتے رہے تھے۔</p>
<p style="text-align: right;">ایوب خان کے دور حکومت میں بلوچ رہنما نوروز خان اور اس کے بھائيوں اور بیٹوں کو پھانسی دے دی گئی تھی جبکہ عطاءاللہ خان مینگل ان کے بھائي نورالدین مینگل، غوث بخش بزنجو، خیر بخش مری، دود ا خان زرکزئي ، اور بلوچ قومی شاعر گل خان نصیر کو بھی غدار قرار دیا جاتا رہا جبکہ اکبر بگٹی کو سزائے موت سنائی گئی جو بعد میں معاف کردی گئی تھی۔</p>

غداروں کی فہرست میں ممتاز بھٹو، حفیظ پیرزادہ، الطاف حسین، مرتضیٰ بھٹو اور بینظیر بھٹو بھی بتائے جاتے رہے۔<br />
تاریخ پلٹا کھاتی ہے اور پھر وہی حسین حقانی جو کہ اپنی اسی خالق اسٹیبلشمنٹ کے ہاتھوں سخت زیر عتاب آئے ہوئے ہیں اور غداری کے مقدمے کی تلوار پاکستانی اسٹیبلشمنٹ حب الوطنی کے کچے دھاگے میں باندھے ان کے سر پر لٹکائے رکھی ہوئی ہے۔ یہ ملک غداروں اور وعدہ معاف گواہوں کی فیکٹری ہے اور منتخب وزرائے اعظم کا مقتل گاہ ہے۔ پھر وہی عاصمہ اسی طرح ان کا مقدمہ لڑتی رہی ہے جس طرح وہ ملک جیلانی کا مقدمہ لڑتی رہی تھی کہ کردار وہی رہتے ہیں صرف غدار بدلتے رہتے ہیں۔</p>

<p>Make so much noise that everything becomes inaudible-then people would hear what we want them to hear. This is how the Pakistani Establishment is controlling the game at the moment &#8211; It is very clear who is who, and what is what. But because of a concentrated effort to remove the current Government and head of state, all the other noises and all other logic is being drowned.</p>
<p>Today the Supreme Court of Pakistan has <em>given</em> the Government six options to remedy the NRO decision. Yes you heard this right, Courts are now providing multiple answer type option to their decisions. I am not aware how this would work in future, would this be that decisions would be given to murders they have six choices, varying degrees of punishment and even a possible acquittal. We provide, you decide.</p>
<p>Court has stated following options:</p>
<p><strong>Option 1: Court would move against the Prime Minister, President and Law Minister because they were &#8216;harping&#8217; that they shall not write a letter to Switzerland, and this equates to violating the court&#8217;s order they have violated their oath to office and so are not worthy of the office. </strong></p>
<p>The Honourable Judge states that Prime Minister made these claims in the floor of the House and Senate. Honourable Judge has made many references to Quran, but perhaps has oversight over Article 69 of The Pakistan constitution that explicitly prohibits any scrutiny of statements made on the House floor. The said speech is non-justiciable in any court as it as it was made in the floor the house &#8211; How has there been such an oversight is amazing.</p>
<p>President made a similar statement in an interview with Hamid Mir &#8211; Be that may, Only way to remove a President is through Article 47 of the constitution, i.e. two-third majority of the Parliament.</p>
<p><strong>Option 2: The Prime Minister and the Law Minister would be held to have made contempt of court, virtue of which both Gentleman could lose their membership of Parliament, and their office along with it.</strong></p>
<p>Though again Article 63 (1) (g) (ridiculing Judiciary or Armed Forces) is mentioned, though again Article 69 defence should apply. Thus only 63 (1) (h) is applicable.</p>
<p><strong>Option 3: Supreme Court would form a commission under Article 187 that shall execute the said relevant decision. </strong></p>
<p><strong>Option 4: Immunity to President under Article 248 has <em>NOT YET BEEN DISCUSSED </em> and if anyone seeks to discuss this in the court, they may do so. </strong></p>
<p>In any case, it is highly astonishing thus far that court has not heard anything under Article 248 presidential immunity, which one would have thought is a highly important defense available to the Government against writing the letter.</p>
<p><strong>Option 5: NAB chairman has failed and protected the accused, namely Ahme</strong><strong>d Riaz Sheikh, and Adnan Khawja who have been appointed wrongly and to take actions against Malik Qayoom.</strong></p>
<p><strong>Option 6: Court may ask the Parliament to take such steps as it sees fit to ensure that court&#8217;s judgement is implement  </strong></p>
<p>It is not clear what court means about handing over the implementation to the Parliament. Does the court expect a resolution by the parliament would suffice, which would first form a commission to ensure implementation and the the said commission can advise parliament of way it has ensure implementation .</p>

<p>The top Pakistani nationalist, ex-winning cricket Captain and recent-wining conspirator Imran Khan read General Pasha’s message in his speech in Lahore in which he disclosed latest conspiracy namely memogate, co-produced by Mansoor Ijaz along with General Pasha. From that day, Imran has been getting wickets through his tsunamic bowling and clean bolded Qureshi, Makhdoom and many others. </p>
<p>The pioneer of this Memogate conspiracy surprised and frustrated Nawaz Sharif so he wanted to play fastforward to satisfy his age old masters in establishment. “Tusee Hukam Karo jee asee……tay puranay Khadim aan” and decided a more bold move compare to Mr. Captain. This move again surprised and frustrated Chaudhry Iftakhar “saano kee lour…..marjawan…jee…. Tusi sanoo bahal kita…o jee hukam” so played more fast forward and allowed Sharif’s petitions on unconstitutional grounds. </p>
<p>Choudhri Iftakhar annoyed on Babar Awan’s retaliation by “Mein Lakh Wari Bismillah Karan” [a very famous Punjabi song] and stopped hearing Z.A Bhutto’s case. The Justice was in fury and issued order for judicial commission. Now advocate Akram Sheikh is representing Nawaz Sharif, Justice Faiz Qazi representing CJ Choudhri and Abrarul Haq a famous singer is representing Imran Khan. </p>
<p>Asaan tay jaana billo day ghar was important song by Abrarul Haq in PTI’s jalsa. Justice Qazi once in his remarks said that judicial commission can visit Mansoor Ijaz in his home in America. Actually he had translated the song by Abrarul Haq and other part of this “Kinay kinay jana bilo thay ghar” is yet to be interpreted by the larger bench of the Supreme Court.</p>
<p>Someone disclosed on a private channel that Mansoor Ijaz is an operative in Black Water think tank and he wish to visit Pakistan’s arsenals. Anyway today six point agenda decided by judicial group over five members in their consultative workshop see final findings pasted below: </p>
<p>01: To initiate the contempt of court proceedings against the Chief Executive and the Secretary Law for not implementing the NRO verdict.<br />
02: To declare the chief executive ineligible from the membership of the Parliament.<br />
03: The court may form a commission to get the verdict implemented.<br />
04: The people themselves decide on the issue and the court exhibit patience.<br />
05: Contempt proceedings against Chairman Nab may be initiated.<br />
06: The action may be taken against President for violating the Constitution.</p>
<p>I think the larger judicial group over 17 members will agree with (04) agenda and will inspire Imran Khan, Nawaz Sharif and Fake Civil Society (FCS) loyal to Generals Pasha and Kayani to agitate against this elected government. </p>
<p>But remember that if Mansoor Ijaz refused to come in Pakistan then be ready to go his home with delegation led by Justice Qazi, Akram Sheikh and Abrarul Haq. </p>

<blockquote><p>The Supreme Court has stated that under the Article 184-3, they have<br />
jurisdiction to hear the petition on alleged memo, because fundamental<br />
rights are directly involved. The three fundamental rights that are<br />
directly at issue are Article 9 (Due Process), Article 14 (Dignity of Man)<br />
and Article 19A (right to information on matters of public information). If<br />
there are any rights breached, it must be that of petitioner, which in this<br />
case is Nawaz Sharif.<br />
Here is the text of Article 9 “No person shall be deprived of life or<br />
liberty save in accordance with law.”<br />
It boggles mind that as petitioner was under no threat of any such loss of<br />
liberty (as he not even a party to any of incidents) it may be assumed that<br />
someone else’s life and liberty were under threat.<br />
Mr Waris Hussain, JD. Writing for Daily Dawn makes an apparently ludicrous<br />
claim that<br />
<a href="http://www.dawn.com/2012/01/08/of-memogate-and-precedence.html">“the implicit argument by the petitioners could be that if the U.S. had<br />
acted on the memo and stopped a military coup from taking place, Pakistan’s<br />
generals and treasonous military personnel would be subject to death or<br />
illegal detention at the hands of the U.S. This hypothetical series of<br />
events was enough to satisfy the Court to continue its probe in order to<br />
protect the fundamental rights of the military”</a></p></blockquote>
<p>&nbsp;</p>
<p>But if Article 9 is at issue, one can’t help but feel if this was in fact what was in Supreme Court’s mind; unfortunately not much discussion is done to elaborate as to the line of thinking that led to this conclusion. It is clear that by having a parallel commission at same time as parliamentary<br />
commission, under the prescribed rules in the proper legislation, National Commissions Act, Mr Haqani’s fundamental rights of due process are arguably being subverted.<br />
As hinted earlier, Mr Sharif is not even party to any of the incidents, yet is a petitioner and court allowed him locus standi (i.e. Standing to fight the case). Now principle is that X, can’t fight Y’s claim against Z, unless X is himself somewhat affected as well. Only exception is that when Y’s<br />
claim is such an issue that it is in Public interest that X should fight this case. There are of course limitations to this, one of this being that X must be a person who represents the people as a whole. No discussion was made in decision as Mr Sharif actually being that person. Similarly there<br />
must be a credible reason why Y himself can’t start litigation. No discussion is made as to this either. It is as if Mr Sharif was given standing as of a right, even though he is not party to facts of the case.<br />
Such are the pitfalls of an activist court that takes suo moto notices of customs relaxations.<br />
Article 14 Text is “(1) The dignity of man and, subject to law, the privacy of home, shall be inviolable. (2) No person shall be subjected to torture for the purpose of extracting evidence.”<br />
I have no idea whose residential privacy was violated, or who has been tortured, nor has the Court in its order explained this predicament. If anything Mr Haqqani’s privacy is going to be breached by court’s demand for his personal Blackberry messages.<br />
Article 19A “Every citizen shall have the right to have access to information in all matters of public importance subject to regulation and reasonable restrictions imposed by law.”<br />
If we are being honest, petitioner’s case mostly is dependent on this Article only. This however is an article that provides the freedom of Information to the public that is held by the Government. It is historically read as an enabling law. If a government agency is holding information against you, and you feel you have a right to it, or if that information is in public interest, then article 19A allows you to sue for that information.<br />
What court has done in a moment of judicial creativity has turned this into a positive law which not only enables but also requires precipitous action, and by further taking it upon themselves to find the ‘facts’ it is submitted that the court has gone five steps further then a role ever<br />
envisaged for a Supreme court in common law system. It taken the role of Judge, legislative (by a highly creative interpretation of Constitution) and executive (by means of the commission) – it was thus already raised by advocate for Hussain Haqqani that court had made itself bias, and by<br />
removing a chance of appeal – it has further subverted due process. Creative reading of Article 19A has also other ‘flood gate’ implications, which normally courts are wary of, and thus avoid such adventures. If the court can on its own accord seek investigate memo issue, in public<br />
interest. What stopped the court from investigating wikileaks? For example the leak that General Kiyani had spoken to US Ambassador about removing President Zardari. Here in addition to all, there is direct application of Article 6 as well. Or what prevents the court from looking into death of Akber Bugti, whose death was arguably violation of Article 9 and 10. In fact, in one of his speeches during the lawyer’s Movement, The Chief Justice alluded to killing of Akber Bugti being extrajudicial, if so, shouldn’t article 19-A not be used here as well. Then there is Death of<br />
Benazir Bhutto, Liquat Ali Khan, Fatima Jinnah and Muhammad Ali Jinnah.<br />
Also the issues of Kargil, Ojri camp, Tashkant Agreement, Niazi Surrender, East-Pakistan and so on. See what I mean by flood gates? This decision is a clear precedent for all other issues to be raised in the court, and with already a enormous workload at all courts, it may be a giant’s burden that<br />
Supreme Court has taken upon itself. One can only speculate why?<br />
Finally is the issue of Due Process. There was already a parliamentary<br />
commission formed under the proper mechanism. If the Supreme Court or<br />
petitioner had any objections to the said commission, a review of the<br />
commission was possible even prior to its investigation. If the court was<br />
worried about the commission’s potency, then more power should have been<br />
recommended. The sphere of investigation may have been increased and if any<br />
people on the commission were questionable, then even that could have been<br />
addressed.<br />
It is not for no reason that Highest Court in Land is being criticised in the country, there have been many liberties taken, and there is a lot of speculation, in the land of conspiracy theories, as to why there may be such an extreme action taken by Supreme Court. Only time would tell .</p>

<p>It seems the infamous memo had indeed threatened to tear down the very security of this country; I wonder why our enemies never figured out this way of neutralising our security apparatus. I am sure our honourable justices know their law very well, and would doubtless have painstakingly stuck to it while reaching their decision of admitting Nawaz Sharif’s petition and constituting the judicial commission to probe into the mystery. The thing with justice is that in addition to being done, it must also be seen to be done. On that count, the Supreme Court’s dispensation of justice in this matter in such an urgent manner raises more than an eyebrow or two, to put it mildly. Also, justice has to be across the board, or else it is not justice to begin with.</p>
<p>On the issue of justice, perceptions are very important. Post 1971, Bhutto, Junejo, Benazir, and Sharif were prematurely removed from office; only Nawaz Sharif was restored by the honourable courts! This history doesn’t make the job of the present justices (although most of whom had nothing to do with these decisions) any easier.</p>
<p>Even if this history doesn’t justify these perceptions, it at least explains them somewhat. Similarly, there is a growing perception among the people that legal cases against say Nawaz Sharif cannot be heard in Pakistan, especially the Punjab, hence the unfortunate LHC(N) and SC (Sharif Court) insinuations. I am sure it is not true of the new unbiased judiciary, but this perception is there nonetheless, and something has to be done about it. Resolution of these perceptions is an uphill task, but we are looking towards the collective wisdom of our honourable justices to achieve it.</p>
<p>Justice Chaudhry, by refusing to buckle under the pressure of a military dictator in 2007, earned genuine and unprecedented respect from the whole nation. What he did wasn’t easy and he could easily have lost his life while standing up to Musharraf and his whole military machinery. Justice Chaudhry displayed both courage as well as wisdom by not giving in to a bully, something that even the otherwise pugnacious Dr Khan couldn’t do. Justice Chaudhry’s defiance was a source of pride for every Pakistani, and he is still widely respected and popular for that.</p>
<p>Like Justice Chaudhry, Sharif also remains popular despite the latest tsunami that has hit the Asian subcontinent. There is, however a big difference between Sharif and Chaudhry: Sharif is a Pakistani politician and, therefore, is neither expected nor obliged to conform to the highest levels of consistency and transparency. Justice Chaudhry, being the deserving head of the highest court of justice, is.</p>
<p>The Supreme Court not only must not dabble in politics (I am sure it doesn’t), it must also be seen not to be doing that. The army chief and Sharif are widely credited – perhaps accurately – for the restoration of wrongfully deposed judges. However, if the free judiciary is seen to be soft on the two parties, it gives an ironic twist to the whole process of restoration of free judiciary, doesn’t it? We already have an institution that can&#8217;t keep itself away from politics, despite it being none of its bloody business. We sure can do without another one.</p>
<p>I am delighted to note that the court of Justice Chaudhry has banished, once for all, the doctrine of necessity. It will be a great day when the bogeyman of national security will also be dispensed with, and petitions such as Asghar Khan’s regarding the ISI’s dispersion of Mehran Bank funds for the benefit of Sharif also start receiving similar attention from the judiciary.</p>
<p>Asma Jahangir is correct about the big elephant in the room that goes unnoticed remarkably regularly. So much so that Yahya Khan (of all generals!) was buried in national colours, and Musharraf was given a 21 gun farewell. True, the judiciary was not free in Yahya’s time but now, thankfully, it is. In case of Musharraf’s crimes, it is still not too late. Who knew, for example, about the secret agreements, the air bases, the NRO guarantors, amongst his close aids? Consistency would demand a thorough investigation, as well as putting the names of a few generals on the ECL until free and fair legal proceedings conclude. Someday, maybe!</p>
<p>With thousands of legal cases of ordinary citizens waiting to be heard for years on end, and the ordinary man having lost all trust in the institution of judiciary for redressing his legal troubles, the judiciary has its plate full in terms of things to do. With this background, urgent dispensation of selective high profile cases is not only justice that won’t be across the board, it will also be nothing more than putting lipstick on a pig as far as the legal troubles of the ordinary Pakistan are concerned.</p>

<strong>Real issue: regime change</strong></p>
<p>There should be no room for confusion. Nor should we put blinders on our eyes. The Memo (with a capital M) has not endangered our nukes or lowered army morale. This last is really absurd. If army morale is to be lowered by a forgotten piece of paper, no matter what was inscribed on it, we are in more danger than we think.</p>
<p>Of all the sacred altars at which the Islamic Republic has allowed itself to be ravaged since 1947, none has been more hallowed than that of national security. The adventures undertaken, the follies perpetrated, in its name. So can we please keep this bogey out of the way?</p>
<p>The Memo is just a handy means to a passionately-desired end: regime change. Getting rid of Asif Zardari and installing a compliant interim setup, leading, at some point in the future, to elections which guarantee “positive results.” Students of Pakistani history would remember that it was Gen Zia who gave currency to the term “positive results.” There is no shortage of retired and serving military men who, in today’s circumstances, translate positive results to mean Imran Khan.</p>
<p>Imran Khan may not be the child of the establishment, as his detractors say, but he is definitely the favourite of the semi-fascist tendencies interwoven into the fabric of our national-security state. Look at the faces he is attracting. What is their recipe for national salvation? Nothing more detailed than discipline and blind faith in the abilities of the leader.</p>
<p>The sages of Raiwind are caught on the horns of a dilemma. It is their petition before the Supreme Court which is keeping the Memo issue alive, army and ISI exploiting this improvised explosive device that they have unwittingly laid (at whose behest, it would be fun to know). The dilemma comes from the circumstance that they can’t be sure how this manoeuvre will play out. Will it lead to early elections, which is what the sages earnestly want, or the sabotaging of democracy?</p>
<p>Hence, the mixed signals from that quarter: even as they push their petition – a position which puts them on the same page as Gen Ashfaq Kayani and Lt Gen Shuja Pasha – they are issuing warnings about the dangers of Bonapartism. Uncharitable critics would say that this amounts to running with the hare and hunting with the hounds, always a tough act to perform.</p>
<p>But it is not only the sages who are confounded. Other actors in this drama are equally confused. They know what they want. They just don’t know, at least at this stage, how to get there. If only Zardari had chosen to stay in Dubai&#8230;it would have been so convenient. But by choosing to come back he has cast a spanner in the works. The conspirators thus have their work cut out.</p>
<p>Zardari can only be nailed if Husain Haqqani chooses to become a Masood Mehmood, the approver in Zulfikar Ali Bhutto’s murder case. But of that happening there are precious few signs. Haqqani is no Masood Mehmood and Gen Kayani, for all his well-concealed ambition, is no Gen Zia. And, if the analogy can be stretched further, on the judicial firmament there is no Justice Anwarul Haq or Maulvi Mushtaq. The times, alas, are different.</p>
<p>So the central problem remains. How do you take the footprints of the Memo affair to the Presidency? And if this doesn’t happen, the mushroom cloud rising in Islamabad is an exercise in futility. To put it in legalese, of what use a First Information Report if it leads to no conviction?</p>
<p>Caesar’s conspirators had the strength of their convictions. Bhutto’s conspirators were animated by fear and hatred. Nawaz Sharif’s own conspirators were driven by feelings of survival. Sharif tried to get rid of Musharraf; he ended up deposing himself. Zardari’s conspirators, and there is a claque of them, have strong feelings but weak impulses: desire unmatched by capacity.</p>
<p>So what we are seeing is a war of attrition instead of a decisive engagement: dark hints, all sorts of rumours (some quite improbable), a regular whispering campaign, but not much clarity about where all this is likely to end.</p>
<p>Maoists used to speak of disorder as a corrective, “There is great disorder under the heavens and the situation is excellent.” Pakistani disorder is a thing of its own, signifying nothing.</p>
<p>People with the kind of reputation the president enjoys are supposed to perform according to a standard script. When you show them their face in the mirror they are supposed to fall at your feet or, like our celebrated Dr Khan, confess to their real or imagined sins on television: hara-kiri, so to speak, in full public view.</p>
<p>Suppose Dr Khan had shown Gen Musharraf some of the courage he displays in his newspaper columns. What would have happened? Whatever Dr Khan did, no one in Pakistan would have dared to hand him over to the Americans.</p>
<p>My Lord the Chief Justice might take a leaf from his own book to gain some insight into the present situation. When he went before Musharraf on March 9, 2007, and was asked in so many words to step down, the standard script required of him either to grovel or sign on the dotted line. But he stood his ground and the rest is history. (It is also a bit of a headache, but let that pass.)</p>
<p>Imagine the warts on Zardari’s face as he is shown the mirror. But he is neither grovelling nor flying out of the country as our ideological warriors would have him do. No article of the Constitution or clause of the penal code covers this frustrating situation. If the president doesn’t wilt or bite the dust, what on earth do you do?</p>
<p>Wait for the election timetable is what, ideally, you should do. But across the political spectrum there is decreasing patience for this option. Nor does it suit everyone. But short of a coup sanctioned by the highest judicial authority, how is regime change to be brought about? Pundits, representing one of the largest growth industries in Islamabad, are left biting their nails as they mull over this conundrum.</p>
<p>To further complicate matters, the PPP is in a bellicose mood and has decided to fight back, which is again not part of the desired script. Their lordships have taken umbrage over a Babar Awan press conference. There is no indication that Dr Awan (his skills honed in that mythical seat of learning, Monticello University) is seeing the light.</p>
<p>No doubt, given the country’s parlous condition, a rejuvenated democracy delivered by fresh elections (as Nawaz Sharif proposes) would be a good thing. But only if there is a willing consensus behind the move, instead of a pistol being put to the PPP’s head.</p>
<p>This makes Shahbaz Sharif’s battle cry that there can be no free elections under Zardari singularly out of focus. As the establishment’s favourite child once-upon-a-time, who would know better than the PML-N that the great instruments of election manipulation in Pakistan are the ideological academies of the ISI and Military Intelligence? ISI and MI are not in Zardari’s control. So what is the PML-N afraid of?</p>
<p>The political class has to be clear about the alternatives on offer. Either we have regime change, courtesy Pakistan’s highest court of constitutional authority, 111 Brigade, in which case politicians can take a rest and a hike for some years. Or, sad to say, we have elections under the present dispensation. Elections, in other words, under Gen Pasha (his name here used as a metaphor) or President Zardari. If there is a third option, the nation may kindly be informed.</p>
<p>The obvious is escaping the PML-N. Its enemy is not Zardari, not in the present circumstances. The PML-N and PPP have separate territories to hold on to. Their interests do not clash. If both have a contradiction it is with the rearing head of Imran Khan’s pseudo-reformism.</p>
<p>If the establishment has made its choice in the form of Imran Khan, there is little sense in playing the establishment’s game by getting so worked up about the Memo affair&#8230;and beating the drums of national security to justify one’s short-sightedness.</p>
<p>The great organ-meister is Gen Pasha. The political class should have imagination enough to think of something else instead of dancing to his tune.</p>

<p dir="ltr">RESPONDENTES</p>
<p>&nbsp;</p>
<p>PETITION under Article 184(3) of the Constitution of Islamic Republic of Pakistan</p>
<p>Respectfully states;</p>
<p>1. The petitioner has the honour and pride of being a citizen of Pakistan. He is also blessed to be a humble common Pakistani without any titles including being the president of any political party or the officer in armed forces, and has the continuous privilege of serving the nation by contributing in gross domestic product of the country by sheer hardwork. Gravely dismayed by the disclosure of certain facts which threaten the very existence of his motherland. So petitioner approaches this August Court craving for its indulgence and intervention to come to the aid of his homeland and to rescue it from the clutches of those who wish it dead.</p>
<p>2. That the petitioner had been appalled to read an article titled &#8220;Time to take Pakistan&#8217;s jihadist spies&#8221; published in an issue of the Financial Times dated October 10, 2011 authored by Mansoor Ijaz respondent wherein it had been claimed, inter-alia, that:</p>
<p>&#8221; Early on May 9, a week after US Special Forces stormed the hideout of Osama bin Laden and killed him, a senior Pakistani diplomat telephoned me with an urgent request. Asif Ali Zardari, Pakistan’s president, needed to communicate a message to White House national security officials that would BYPASS  Pakistan’s MILITARY AND INTELLIGENCE CHANNELS. The embarrassment of bin Laden being found on Pakistani soil had humiliated Mr Zardari’s weak civilian government to such an extent that THE PRESIDENT FEARED A MILITARY TAKEOVER WAS IMMINENT…..<br />
Gen Ashfaq Kayani, the army chief, and his troops were demoralised by the embarrassing ease with which US special forces had violated Pakistani sovereignty. Inter-Services Intelligence, Pakistan’s FEARED SPY SERVICE, was charged by virtually the entire international community with complicity in HIDING BIN LADEN  for almost six years. BOTH (ISI &amp; ARMY) CAMPS WERE LOOKING FOR A SCAPGOAT; Mr Zardari WAS THEIR MOST CONVENIENT TARGET was their most convenient target.”</p>
<p>3. That later on, a frightfully disturbing comment also came from the spokesman of Admiral Mike Mullen to the effect that:</p>
<blockquote><p>&#8220;Adm. Mullen had no recollection of the memo and no relationship with Mr. Ijaz. After the original article appeared on Foreign Policy&#8217;s website, he felt it incumbent upon himself to check his memory. He reached out to others who he believed might have had knowledge of such a memo, and one of them was able to produce a copy of it,&#8221; Kirby said. &#8220;That said, neither the contents of the memo nor the proof of its existence altered or affected in any way the manner in which Adm. Mullen conducted himself in his relationship with Gen. Kayani and the Pakistani government. He did not find it at all credible and took no note of it then or later. Therefore, he addressed it with no one.&#8221;</p></blockquote>
<p>This confirmation of the existence of the memo in question and its receipt by Chief of Staff of the U.S. Armed Forces, was a shocking disclosure of how brazenly, the democratic government was threatened by the military yet again, if all this was true, and that also only for the power hungry generals.</p>
<p>4. That Mansoor Ijaz released the Black Berry Message conversation which inter-alia mentions that:</p>
<blockquote><p><strong><em>“I was just informed by senior US intel that GD-SII (read DG-ISI) Mr P asked for, and received permission, from senior Arab leaders a few days ago to sack Z.”</em></strong></p></blockquote>
<p>Where, according to Mr. Mansoor Ijaz, Mr. P referred to DG ISI General Pasha. It is also a known fact that during this period DG ISI visited the Arab countries during that period.</p>
<p>5. That a further blow to a patriotic mind came from the availability of the said memo, which had since been made public by those possessed of the same. The said memo which now stands published and is available even on the internet reads as under:</p>
<blockquote><p><em>CONFIDENTIAL MEMORANDOM</em><br />
<em> BRIEFING FOR ADM. MIKE MULLEN, CHAIRMAN, JOINT CHIEFS OF STAFF</em><br />
<em> During the past 72 hours since a meeting was held between the president, the prime minister and the chief of army staff, there has seen a significant deterioration in Pakistan s political atmosphere. Increasingly desperate efforts by the various agencies and factions within the government to find a home &#8211; ISI and/or Army, or the civilian government &#8211; for assigning blame over the UBL raid now dominate the tug of war between military and civilian sectors. Subsequent tit-for-tat reactions, including outing of the CIA station chief s name in Islamabad by ISI officials, demonstrates a dangerous devolution of the ground situation in Islamabad where no central control appears to be in place.</em></p>
<p><em>Civilians cannot withstand much more of the hard pressure being delivered from the Army to succumb to wholesale changes. If civilians are forced from power, Pakistan becomes a sanctuary for UBL s legacy and potentially the platform for far more rapid spread of al Qaeda s brand of fanaticism and terror. A unique window of opportunity exists for the civilians to gain the upper hand over army and intelligence directorates due to their complicity in the UBL matter.</em></p>
<p><em>Request your direct intervention in conveying a strong, urgent and direct message to Gen Kayani that delivers Washington s demand for him and Gen Pasha to end their brinkmanship aimed at bringing down the civilian apparatus &#8211; that this is a 1971 moment in Pakistan s history. Should you be willing to do so, Washington s political/military backing would result in a revamp of the civilian government that, while weak at the top echelon in terms of strategic direction and implementation (even though mandated by domestic political forces), in a wholesale manner replaces the national security adviser and other national security officials with trusted advisers that include ex-military and civilian leaders favorably viewed by Washington, each of whom have long and historical ties to the US military, political and intelligence communities. Names will be provided to you in a face-to-face meeting with the person delivering this message.</em></p>
<p><em>In the event Washington s direct intervention behind the scenes can be secured through your personal communication with Kayani (he will likely listen only to you at this moment) to stand down the Pakistani military-intelligence establishment, the new national security team is prepared, with full backing of the civilian apparatus, to do the following:</em></p>
<p><em>1. President of Pakistan will order an independent inquiry into the allegations that Pakistan harbored and offered assistance to UBL and other senior Qaeda operatives. The White House can suggest names of independent investigators to populate the panel, along the lines of the bipartisan 9-11 Commission, for example.</em></p>
<p><em>2. The inquiry will be accountable and independent, and result in findings of tangible value to the US government and the American people that identify with exacting detail those elements responsible for harboring and aiding UBL inside and close to the inner ring of influence in Pakistan s Government (civilian, intelligence directorates and military). It is certain that the UBL Commission will result in immediate termination of active service officers in the appropriate government offices and agencies found responsible for complicity in assisting UBL.</em></p>
<p><em>3. The new national security team will implement a policy of either handing over those left in the leadership of Al Qaeda or other affiliated terrorist groups who are still on Pakistani soil, including Ayman Al Zawahiri, Mullah Omar and Sirajuddin Haqqani, or giving US military forces a &#8220;green light&#8221; to conduct the necessary operations to capture or kill them on Pakistani soil. This &#8220;carte blanche&#8221; guarantee is not without political risks, but should demonstrate the new group s commitment to rooting out bad elements on our soil. This commitment has the backing of the top echelon on the civilian side of our house, and we will insure necessary collateral support.</em></p>
<p><em>4. One of the great fears of the military-intelligence establishment is that with your stealth capabilities to enter and exit Pakistani airspace at will, Pakistan s nuclear assets are now legitimate targets. The new national security team is prepared, with full backing of the Pakistani government &#8211; initially civilian but eventually all three power centers &#8211; to develop an acceptable framework of discipline for the nuclear program. This effort was begun under the previous military regime, with acceptable results. We are prepared to reactivate those ideas and build on them in a way that brings Pakistan s nuclear assets under a more verifiable, transparent regime.</em></p>
<p><em>5. The new national security team will eliminate Section S of the ISI charged with maintaining relations to the Taliban, Haqqani network, etc. This will dramatically improve relations with Afghanistan.</em></p>
<p><em>6. We are prepared to cooperate fully under the new national security team s guidance with the Indian government on bringing all perpetrators of Pakistani origin to account for the 2008 Mumbai attacks, whether outside government or inside any part of the government, including its intelligence agencies. This includes handing over those against whom sufficient evidence exists of guilt to the Indian security services.</em></p>
<p><em>Pakistan faces a decision point of unprecedented importance. We, who believe in democratic governance and building a much better structural relationship in the region with India AND Afghanistan, seek US assistance to help us pigeon-hole the forces lined up against your interests and ours, including containment of certain elements inside our country that require appropriate re-sets and re-tasking in terms of direction and extent of responsibility after the UBL affair.</em></p>
<p><em>We submit this memorandum for your consideration collectively as the members of the new national security team who will be inducted by the President of Pakistan with your support in this undertaking.</em></p>
<p>&nbsp;</p></blockquote>
<p>6. That a bare perusal of the above quoted memorandum in question and its content would reveal that Pakistani nation was once again live under the fear of military junta take-over which the honourable judges of this August Court and the people of Pakistan are quite familiar, to say the least, the said contents, inter-alia :-</p>
<ul>
<li>a, Reveal that the generals of Pakistan once again planned a coup against the democratic elected government, following the tradition of their predecessors.</li>
<li>b, declare the generals of Pakistan military and her agencies to be guilty of “&#8230;.. THEIR COMPLICITY IN THE UBL (Usama bin Laden) MATTER.”</li>
<li>c, Civilian government is threatened and is put under pressure and generals plan to make the democartically elected president of Pakistan a scapegoat and dismissed through extra-constitutional measures.</li>
</ul>
<p>7. That the contents of the MEMORANDUM in question reflect the current state of affair in the country, the generals have put the gun on the heads of people of Pakistan and are continuously busy in planning coup d&#8217;etat against the democratically elected government and derail the democratic process of which honourable judges, this August Court and the common people of Pakistan are major stakeholders.</p>
<p>8. That since the very existence of the State stands put at stake theryby threatening the fundamental rights of the people to life, liberty, property, trade, and profession as guaranteed by the Articles 9, 14, 15, 16, 23, 24, of the Constitution, therefore the petition which involves serious question of public importance related to the enforcement of the said fundamental rights, deserves immediate attention of this August Court.</p>
<p>&nbsp;</p>
<p dir="ltr">WHEREFORE, it is respectfully prayed, in the name of Pakistan, in the name of those who founded it with their sweat and blood and in the name of common people of Pakistan who work hard to keep the ideal of Pakistan alive, that:</p>
<ul>
<li>a, all the respondent be summoned to appear, before this Honourable Court in person to explain their position on the contents of this MEMORANDUM.</li>
<li>b, the dreadful conspiracy to undermine, overthrow the democratically elected government and derail the democratic process, be un-earthed, and</li>
<li>c, the culprits exhibiting grave disloyalty to the State, the constitution of Pakistan and people of Pakistan and who are found guilty of the crimes as afore-said be brought to book.</li>
<li>d, the Cheif of Army Staff General Ashfaq Pervez Kayani (Respondent Number 1) and Director General Inter Services Intelligence General Pasha (Rrespondent Number 2) be immediately refrained from exercising their duties so that during the investigation they can not exert any pressure due to their position.</li>
</ul>
<p dir="ltr">Any other, better and appropriate relief or action warranted by the stated or the discovered facts, may also be graciously granted or taken.</p>

<p>The military eliminated all Bhuttos because Zulfiqar Ali Bhutto, Benazir Bhutto, Murtaza and Shah Nawaz Bhutto did not accept dictation but Asif Zardari, a non-Bhutto, is no different than Bhuttos and this is the reason of generals’ annoyance with Zardari.</p>
<p>Generals are desperate to remove President Zardari through the Supreme Court as they believe that independent civilians cannot govern the land of the pure.</p>
<p>The military is after President Asif Zardari’s head because in him generals see a challenger. They want to punish the President because he is not a puppet. The military’s indignation at Zardari is rooted in the paranoia that only the military can save Pakistan and also it is the sole right of generals to set the contours of Pakistan’s foreign and defence policies.</p>
<p>Devious military minds have played the Imran Card to blackmail the opposition leader Nawaz Sharif. As expected the Sharif brothers panicked after leaks that the military was behind Imran Khan and that Khan would hurt Muslim League (N) vote bank, particularly in the Punjab Province.</p>
<p>Nawaz Sharif and generals have common masters. They take their cues from Saudi Arabia. Saudi royals provide ideological sanctity plus free oil and money. The United States is the Godfather of Saudi royals and Pakistani generals. Actually, Pakistan is part of an international strategic and security system that has been built to protect the U.S. interests in the region. The U.S. led alliance is a deadly web of multiple purposes and missions.</p>
<p>In the 1980s, Washington, Riyadh and Rawalpindi fought against the Soviet Union together but within that alliance all the three pursued different agendas. Even today, the United States and Saudi Arabia are using Al-Qaeda extremists in Syria and Libya and also against Iran. There could be links between some American figures and terrorist groups which operate in western China, Russian Caucasus region and Central Asian states. At the same time militant groups are targeting the U.S. in Afghanistan. It is a very complicated situation in which the U.S. Pakistan and Saudi Arabia are allies and foes.</p>
<p>Zulfiqar Ali Bhutto was a visionary, he would never let Pakistan to be used as a proxy therefore he was killed. Benazir Bhutto feared Americans, Saudis and Pakistani generals but she did not accept their dictation. Eventually she was killed, too.</p>
<p>Nawaz Sharif has been a product of the U.S., Saudi and Pakistani axis. Though he was a manufactured leader at one point he tried to be in control but failed and his Saudi masters came to his rescue. Nawaz Sharif was annoyed as he considered the GHQ his constituency but felt that his own camp had betrayed him. However, now it appears that generals have successfully twisted Nawaz Sharif’s arm by using Imran as a threat.</p>
<p>Pakistani generals do not forgive politicians who do not follow the military line. The military made an example of Zulfiqar Ali Bhutto for pursuing independent policies. Muhammad Khan Junejo was punished when he disagreed with generals over Afghanistan. Benazir Bhutto was declared a security risk because she had opened negotiations with India and had invited the Indian Prime Minister Rajiv Ghandi to Pakistan.</p>
<p>The military’s own man Nawaz Sharif realized that Pakistan’s survival depends on peace with India and when he was about to achieve peace with India, his generals stabbed him in the back.</p>
<p>President Zardari is an enemy because he, too, has been trying to readjust Pakistan’s foreign policy. Unlike Nawaz Sharif, Asif Zardari is an outsider so were Z.A. Bhutto and Benazir Bhutto.</p>
<p>There are interesting similarities in circumstances in which Z.A. Bhutto and Asif Ali Zardari took the so-called power in Pakistan. Bhutto was invited to take charge when generals had lost half of the country. Since the military was weak and defeated, Bhutto used the opportunity to fix problems and build institutions. He performed miracles in his very brief tenure. Under his leadership Pakistan attained international recognition, the country got its first constitution and there was reconstruction and reorganization in all spheres. Whatever post independence legal and institutional setup Pakistan has, it was initiated and launched by Bhutto. But generals didn’t give Bhutto time to further establish civil rule in Pakistan.</p>
<p>Asif Zardari became President when Benazir was murdered and the military was in a defensive position. Generals were relieved after Benazir’s elimination and took Asif Zardari for granted. They underestimated Zardari and thought that they would use him but he surprised them.</p>
<p>Zardari is far more intelligent than other politicians. He possesses unique and extraordinary leadership skills and qualities. He is non-confrontational and can be flexible without compromising on his principles and agenda. He adopts and adjusts to changing circumstances. Also he is an extremely patient person.</p>
<p>Following his election as the President his strategy has been brilliant. He avoided limelight and didn’t take credit for his achievements. He willingly gave up presidential powers and ignored his enemies&#8217; attacks. His choice of Prime Minister was a good one. He and Gillani made an excellent team and it puzzled many of their opponents.</p>
<p>By keeping a low profile Asif Zardari undertook a very delicate and extraordinary task of steering Pakistan out of crisis. He gave the military the freedom to deal directly with their masters in Washington and Riyadh. The military has been setting the terms of war on terror and related security issues.</p>
<p>President Zardari, on the other hand, embarked on a different course. He started building bridges with regional players. He visited China half a dozen times and his efforts have given new impetus to Pakistan-China relations. He has been actively working on opening trade and energy routes between Central Asia and Pakistan and trade links between India and the latter.</p>
<p>Never before a Pakistani leader pursued relations with Russia and Central Asian states with such vigour. Under Zardari Pakistan has signed landmark bilateral agreements with Russia and Central Asia. Despite pressure from the United States and Saudi Arabia, Zardari established deeper and concrete relations with Iran and he enjoys the trust of the Iranian leadership. President Zardari’s master stroke, however, was declaring India as Pakistan’s most favourite trading partner.</p>
<p>Indeed President Zardari has laid foundations for a new foreign policy; this has earned him many powerful internal and external enemies. The President’s foreign policy initiatives have alarmed the GHQ and its godfathers in Riyadh and Washington.</p>
<p>While the President was busy in synthesizing a new role and image of Pakistan, generals continued their games of deception. General Zia-ul-Haq started playing double game in the so-called Afghan Jihad, General Parvez Musharraf followed General Zia’s path in the so-called ‘war on terror’. That tradition continues as the current Army Chief, General Ashfaq Parvez Kayani, and several of his associates were part of General Musharraf’s team.</p>
<p>Some Pakistani generals allowed U.S. drone attacks and at the same time protected and encouraged the Taliban. They were fighting the war on terror but also provided shelter to Osama Bin Laden. They never bothered to seek permission or even inform civilian governments of their acts. Generals’ wisdom has caused irrecoverable damage to Pakistan.</p>
<p>Now Pakistan is isolated and condemned due to the foolish policies of its generals. The world sees Pakistan as a rough state because of its military. In fact, the military is responsible for the decay and destruction of Pakistan and yet generals jealously guard their control over the country and are incapable to think introspectively.</p>
<p>Pakistani generals were responsible for the breakup of the country in 1971. Because of them Pakistan is at perpetual war with India, generals have dragged the country into the Afghan quagmire, the menaces of extremism and sectarianism polluted the Pakistani society during military rules.</p>
<p>Since the late 1950s, the military has been asserting itself as a symbol of national unity and identity. As the most organized and powerful institution in the country the military has been ruling Pakistan directly and indirectly and has manufactured an ‘ideology of Pakistan’.</p>
<p>From the standpoint of the Pakistani military, to be a patriotic Pakistani means having a firm and unconditional belief in the military’s religious and nationalistic perspective. The Pakistani military has illusions about Pakistan’s place in the world. Pakistan’s Westernized, whisky drinking and English speaking generals have a worldview that is flawed and outdated; the trouble is that they do not realize it.</p>
<p>During the last 30 years, an ill-conceived Islamization process has poisoned many military minds and it is reflected in their perceptions of nationalism and patriotism. The military thinking is rooted in distorted and inflated historical claims about Muslims’ glory and false narratives of Islamic history.</p>
<p>The military’s incapacity to shed its illusions and insane concepts is Pakistan’s major problem. However, generals are not completely idiots. Keeping Pakistanis sunk in the ocean of confusions, illusions and misconceptions could be a calculated strategy that aims to protect military’s financial interests and political hegemony.</p>
<p>One part of the military sponsored spread of ignorance in Pakistan is deliberate with the strategic goal of maintaining control. The other aspect of this mindset, however, is ideological and is based on a misplaced racial and spiritual superiority complex.</p>
<p>The military’s ideological foundations stem from the notion of Islamic Renaissance and revival of the ‘Muslim glory’.</p>
<p>The military uses selective works of a philosopher and poet Sir Muhammad Iqbal and his vision of Muslims’ uplift and advancement. Iqbal was a great intellectual but many of his ideas related to Islam are confused and contradictory. He is also misrepresented and misunderstood in Pakistan.</p>
<p>Since the 1960s, the Jamaat-e-Islami (JI) has been making inroads in the ranks of Pakistan’s military. Before the 1971 war with India, the military and JI made an alliance that killed hundreds and thousands of Bengalis in the East Pakistan. From there on, the JI became a civilian regiment of the Pakistan military. By the 1980s, Mulanna Mudoodi, the founder of Jamaat-e-Islami, had become an ideological role model for many senior and junior officers of the Pakistani military.</p>
<p>The JI is another face of Al-Qaeda. If Jamaat-e-Islami is a tree, groups such as Al-Qaeda, Jamat ul Dawah, Lashker Jhangvi and dozens of others in Pakistan as well as Egyptian Muslim brotherhood are its branches. Therefore it is fair to say that for the last 30 years there is ideological conformity between extremists and some in the Pakistani military. However, the good sign is that now the military has learnt hard lessons and there is a growing  realization within its ranks about the negative effects of hard-line and extremist policies. Extremism needs to be purged completely from the military minds.</p>
<p>But Pakistan’s troubles will end with the end of the military’s domination in politics. Generals must give time to civilian leadership. The country needs a new start, a new set of rules and a new civil-military partnership where the military and the civil society are not at odds but stand shoulder to shoulder and defend and define Pakistan with one voice. A change in the military mindset is prerequisite for such a change.</p>

<strong>نواز شریف سے ایسی توقع نہ تھی</strong></p>
<p style="text-align: right;">خاکی وردی والے کب تک مشرف کے بوجھ تلے دبے رہتے لیکن اگر زرداری صاحب آرٹیکل چھ کو بروکار لاتے اورمشرف کو محفوظ راستہ دے کر بھگانے کے بجائے الٹا لٹکا دیتے، اگر سیاسی یتیموں کو بے ساکھی پکڑا کر کھڑا نہ کرتے اور جمہوریت کو مستحکم کرتے تو آج خودانکی گردن کے گرد رسی اتنی تنگ نہ ہوتی اور انہیں یوں بیماری کا بہانہ بنا راتوں رات ملک سے فرار نہ ہونا پڑتا۔ عقل مگر ان میں نہیں، سیاست سے سے انکو بیر نہیں اور فہم فراست انکے بس کی بات نہیں۔ مختصر یہ کہ کسی کو اگر اسکی سوچ سے زیادہ مل جائے تو جو حشر اسکا ہوسکتا ہے زرداری صاحب کا بھی وہی ہوا ہے۔ چار برس تک پیپلز پارٹی کہتی رہی کہ زرداری سیاست کی کتاب،عقل کی کسوٹی اور تدبر کا پہاڑ ہیں لیکن اس طالب کا ہمیشہ یہی موقف رہا کہ زرداری صاحب صرف فوج اور امریکہ کی خوشنودی کو اقتدار کی بقا سمجھتے ہیں اور ایک دن یہی فوج اور امریکہ انہیں اقتدار سے نکال باہر کرے گی۔</p>
<p style="text-align: right;">لوگوں کو سمجھ نہیں آتی کہ خاکی وردی والے ہوں یا سات سمندر دور بیٹھے امریکی بہادر، دونوں میں ایک قدر مشترک ہے کہ جتنی بھی جتن کرلو یہ رازی نہیں ہوتے اور موقع ملتے ہی وار کرکے کچا کھا جاتے ہیں۔ ان دونوں سے جان چھڑانے لے لئے زرداری کو وقت نے سب سے زیادہ موقع دئے، کیانی جیسے کمزور ترین فوجی آدمی سے معاملات طے کرنا اور انسداد دہشت گردی کی جنگ سے باہر آنا مشکل نہ تھا اور وہ بھی ایسے حالات میں جب ادھر پاکستان میں فوجی وردی منحوست کا ایک نشان بن چکی ہو اور ادھر افغانستان میں امریکہ بری طرح پھنس چکا ہو۔ سونا پر سہاگہ جہاں ایک طرف نواز شریف ایسے بھی فوجی اسٹبلشمنٹ پر برستے ہوں، سپریم کورٹ دستور اور جمہوریت کے ترانے گاتی بحال ہوئی ہو اور مذہبی سیاسی جماعتوں کے دلوں میں فوجی وقار ایک قصہ پارینہ بن چکا ہو وہاں دوسری طرف ملک کے لبرل ترین حلقے بھی افغانستان میں امریکی شکست کا اعتراف کرتے نہیں تھکتے ہوں۔</p>
<p style="text-align: right;">چار برس ہوتے ہیں، نواز شریف اور زرداری نے ہاتھ ملائے اور ساتھ چلنے کے وعدے کئے اور یقینا دونوں کو اس سے بہتر موقع تاریخ نے کبھی نہیں دیا تھا۔ چاہتے تو مل کر اسٹبلشمنٹ کو ایسا تگنی کا ناچ نچاتے کہ سارے غاصبوں کو اپنی نانیاں یاد آجاتیں مگر زراداری نے آتے ہی مشرف کو گلے لگایا، ڈوگر کورٹ سے ہاتھ ملائے اور فوجی اسٹبلشمٹ کو اس طرح کی ضمانتیں دیں جو اٹھاسی اور ترانوے میں انکی اہلیہ دیا کرتی تھیں۔ نتیجے کے طور پر جہاں نواز شریف کو ہاتھ چھڑا کر بحالی جمہوریت کے عوامی دباو کے سمت بہنا پڑا وہیں خود پیپلز پارٹی بھی داخلی انتشار کا شکار ہوگئی۔ اٹھارویں ترمیم سے زیادہ ضروری کام عدلیہ کی بحالی اور مشرف کی رخصتی تھی جن میں پس و پیش سے کام لیا گیا اور سب سے اہم عمل مشرف کا ٹرائل تھا کہ اسے عبرت کی مثال بنایا جاتا مگر افسوس کہ گریز کیا گیا۔مشرف کی بنائی خارجی، دفاعی اور معاشی پالیسوں کا تسلسل زرداری حکومت کا سب سے بڑا جرم تھا کیونکہ مشرف کے خلاف انقلاب صرف اس لئے نہیں آیا تھا کہ وہ ایک آمر تھا بلکہ اس انقلاب کے پیچھے وہ عوامل بھی کارفرماں تھے جنکے نتیجے میں ملک ایک پرائی جنگ میں الجھ کر تباہ ہورہا تھا۔</p>
<p style="text-align: right;">زرداری نے امریکہ اور فوج کی رضامندی کی خاطر سب کو ناراض کیا لیکن چونکہ ان دونوں قوتوں کی خواہشات کو کوئی سیاسی لیڈر آج تک پورا نہیں کرسکا چناچہ زرداری صاحب بھی نہ کرسکے اور آج وہی دنوں قوتیں انکے در پہ ہوگئیں۔ نتیجے کے طور پر وہ اکیلے کھڑے ہیں اور ناراض ہونےوالوں میں کوئی ان دو قوتوں کی سازشوں کا مہرا بنا ہوا ہے اور کوئی خاموش تماشائی بنا ہوا ہے۔منصور اعجاز بھی سازش کا صرف ایک مہرا ہے۔</p>
<p style="text-align: right;">عجیب بات ہے کہ پاکستانی میڈیا سیاستدانوں نے منصور اعجاز ایسے بدنام زمانہ شخص کی باتوں میں آکر ایک طوفان بدتمیزی بپا کیا ہوا ہے۔ حالانکہ نہ اسکا مکروہ ماضی کسی کی نظر سے چھپا ہے اور نہ ہی کوئی اسکی اسلام دشمنی سے بے خبر ہے۔</p>
<p style="text-align: right;">منصور اعجاز اپنی چالاکیوں کے زریعے ماضی میں کئی بار نواز شریف اور بے نظیر کے قریب آنے کی کوشش کرتا رہا۔ یہ عجیب اسٹوری ہے کہمنصور اعجاز جو خود کو ایک محب وطن امریکی بزنس مین کہتا ہے اور پاکستان سے اپنی کھلی لاتعلقی کا اعلان کرتا ہے کسی خفیہ ادارے کے جاسوس کی طرح پہلے حسین حقانی کو فوجی بغاوت کے خوف میں مبتلا کرتےہوئے اس مبینہ خطرے سے نکلے میں اپنی خدمات پیش کرتا اور پھر خود ایک آرٹیکل لکھ کر بھانڈا پھوڑ دیتا ہے۔ اگر منصور اعجاز کے الزامات درست مان لئے جائیں تو پھر اس نے یہ بھی لکھا ہے کہ جرنل پاشا پاکستان میں بغاوت کے لئے عرب حکمرانوں سے مدد مانتا رہا اور یقینا یہ الزام حسین حقانی پر لگائے گئے الزامات سے زیادہ سنگین ہیں تو سوال یہ پیدا ہوتا ہے کہ میڈیا ان الزامات پر کیوں خاموش ہے۔غداری کے الزامات کچھ عرصہ قبل زولفقار مرزا نے بھی قرآن سر پر رکھ کر الطاف حسین اور رحمان ملک پر بھی لگائے تھے اور ان انہوں نے میڈیا کے سامنے ایک مبینہ خط پیش کیا تھا۔ وہ الزام منصور اعجاز کے الزام سے کہیں زیادہ سنگین تھا کیونکہ اس میں ملک توڑنے کی بات تھی۔ دوسری طرف الزام لگانے والا کوئی اور نہیں ملک کی حکمران جماعت کا رکن، سابق صوبائی داخلہ، صدرمملکت کا دوست اور اسپیکر قومی اسمبلی کا شوہر تھا لیکن زولفقار مرزا کے الزامات پر سپریم کورٹ حرکت میں کیوں نہ آئی ؟</p>
<p style="text-align: right;">جو غلطی زرداری کرچکے اب اس غلطی کا اعادہ میڈیا، سپریم کورٹ اور نواز شریف کرنے جارہے ہیں، اوروں کو چھوڑیں کم از کم نواز شریف سے ایسی توقع نہ تھی، ایک اطمینان تھا کہ وہ ماضی سے سبق سیکھ چکے ہیں اور اسٹبلشمنٹ کی لائن پر اب کبھی نہیں آئیں گے مگر افسوس۔اس سازش کا مہرہ بننے سے ناصرف ان لوگوں کی اپنی ساخت بری طرح مجروع ہورہی ہے بلکہ ملک ایک بار پٹری سے اتر کر اسٹبلمنٹ کے آہنی پنجے میں جاتا نظر آرہا ہے۔اگر ان لوگوں نے ہوش کے ناخن نہ لئے تو ناصرف انہیں وہ خمیازہ بھگتنا پڑے گا جو زرداری صاحب تادم تحریر بھگت رہے ہیں بلکہ ملک کو بھی بہت بھاری قیمت دینی پڑے گی۔چار برس تک پیپلز پارٹی کہتی رہی کہ زرداری سیاست کی کتاب،عقل کی کسوٹی اور تدبر کا پہاڑ ہیں لیکن اس طالب کا ہمیشہ ہی یہ موقف رہا کہ زرداری صاحب صرف فوج اور امریکہ کی خوشنودی کو اقتدار کی بقا سمجھتے ہیں اور ایک دن یہی فوج اور امریکہ انہیں اقتدار سے نکال باہر کرے گی۔</p>
